Heard the learned counsel on either side.

2. This criminal original petition has been filed for quashing the impugned proceedings.

3. The defacto complainant is present before this Court through video conferencing. She has been duly identified by Ms.K.Baubynasuki, WHC-2839 attached to the first respondent police station and the same has been duly confirmed by Mr.M.Sakthi Kumar, learned Government Advocate.

4. Though the case involves the offence under Section 376 of I.P.C., the partied have got married and they are living under one roof. The parties have filed a joint compromise memo. The defacto complainant states that she does not want to pursue the matter. Therefore, it would not be proper to continue the impugned prosecution.

5. The impugned proceedings are quashed. This criminal original petition is allowed. The joint compromise memo shall form part of the record.
