ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 12.11.2025 for the offences punishable under Sections 75, 115(2) of BNS, 2023 and Section 7 r/w. 8 of the POCSO Act, 2012 , in Crime No. 36 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner forced the victim child to love him through mobile phone communications, subjected her to sexual harassment and also molested the victim. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that this is a second bail petition, earlier bail petition was dismissed by this Court on 12.12.2025 and now the present petition has been filed on the ground of a change of circumstances that the charge sheet has been filed before the Concerned Court. He further submitted that the petitioner is in judicial custody from 12.11.2025. Hence, he seeks bail to the petitioner. 2/4

4. The learned Additional Public Prosecutor submitted that the offences committed by the accused are serious in nature and that the victim is 14 years old. Therefore, he opposed for grant of bail to the petitioner.

5. Earlier, the bail petition filed by the petitioner was dismissed in detail after perusal of the statement recorded under Section 164 of Cr.P.C. Therefore, this Court is not inclined to accept the contention of the learned counsel appearing for the petitioner that the charge sheet has been filed before the concerned Court amounts to a change in circumstances. Since the petitioner/accused being a teacher, allegedly indulged in such activities with a 9th standard student, which is unbecoming of a teacher, this Court is not inclined to entertain the present petition. Accordingly, this criminal original petition is dismissed. The learned counsel for the petitioner is directed to take necessary steps to ensure the trial is completed at the earliest.
