ORDER : The Court Made the following order :- The petitioner who is arrayed as accused in Crime No.477 of 2015 on the file of the respondent police apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 342, 294(b), 324 and 506(ii) I.P.C and hence, seek anticipatory bail.
2. The case of the prosecution is that due to prior enmity, the accused are said to have abused the defacto complainant with filthy language and the accused are said to have assaulted him indiscriminately and also threatened him with dire consequences.
3. The learned counsel for the petitioners submitted that a false complaint has been lodged against the petitioner with malafide intention and the first accused was arrested and released on bail by the court below.
4. The learned Government Advocate(Crl.side) appearing for the State submitted that the victim in this case was treated as outpatient.
5. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Dindigul, and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties for a like sum to the satisfaction to the learned Magistrate concerned and on https://hcservices.ecourts.gov.in/hcservices/
further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready failing which, the petition for anticipatory bail stands dismissed.
