O R D E R
This Writ Petition is filed seeking a direction to the respondents 2 and 3 to consider and dispose of the petitioner's representation dated 06.12.2023, seeking appointment of a Fit Person/Special Officer to temporarily administer "Illathu Pillaimar Madam", situated at 43, Adivaram, Nearby Thiru Aavinankudi Temple, Palani and to take appropriate action against the respondents 4 and 5, within a specified time frame as fixed by this Court.
2. The learned counsel appearing for the petitioner would submit that the petitioner is a President of Illathu Pillaimar Madam. The 4th respondent is the then President of the said Madam. The 4th respondent, along with the then Secretary and Treasurer, failed to submit 2/6
proper accounts and is making continuous and unlawful attempts to retain control over the Madam, thereby seriously endangering its proper administration. Therefore, the petitioner has sent a representation on 06.12.2023, seeking appointment of a Fit Person/Special Officer to temporarily administer "Illathu Pillaimar Madam", situated at 43, Adivaram, Nearby Thiru Aavinankudi Temple, Palani and to take appropriate action against the respondents 4 and 5. Since the said representation was not considered till date, the petitioner has filed this Writ Petition.
3. The learned Government Advocate appearing for the respondents 1 to 3 would submit that since the Illathu Pillaimar Madam is not registered either under the Registration Act or Societies Act, they are not in a position to consider and pass orders on the representation of the petitioner.
4. This Court heard the submissions made by the learned counsel appearing on either side and perused the materials available on record.

Considering the facts and circumstances of the case, this Court is of the view that, when the petitioner is acting as the President of the subject Madam and the previous management has refused to hand over the accounts, the appropriate course available to the petitioner is to file a civil suit and obtain a decree for the handing over of the accounts Instead of adopting the said course, the petitioner has approached this Court, which is not proper. Further, with regard to the misappropriation of funds or the commission of any other offence on the part of Respondents 4 and 5, the petitioner may lodge a complaint with the jurisdictional police and take appropriate action in accordance with law
6. In view of the above, this Court is not inclined to entertain this Writ Petition and the same is liable to be dismissed. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. 25.02.2026 vsm Index : Yes/No NCC : Yes/No 4/6
