O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to subdivide and survey the land comprised in S.No.632/3B, measuring 0.06.33 ares (about 16 cents), in Kondangipatti Village, and S.No.557/1, measuring 0.04.00 ares (about 10 cents), in Kondangipatti Village, on the basis of the petitioner's online Application No.20210811330347 dated 11.08.2021.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that an online application was made in the year 2021 itself, seeking demarcation of the boundaries of the property in question.

The learned Additional Government Pleader appearing for the respondents would submit that the application filed by the petitioner in the year 2021 had been considered and disposed of; and that however, in the event of the petitioner filing a fresh application, after consideration of the claims of the parties, appropriate steps would be taken to demarcate the Page No. 2 of 5

land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Writ Petition is disposed of with liberty to the petitioner to file a fresh application for survey of the land and demarcation of the boundaries. In the event of the petitioner filing such fresh application, the concerned authority shall consider the same, demarcate the petitioner's land after considering the claims of all parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of the said application. In the event of any rival claims, the parties may be instructed to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners and other interested parties, if any. There shall be no order as to costs.
