PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to re-issue the passport of the petitioner, based on his application dated 08.12.2025 bearing file No. MD1076074942225 within a time frame as may be stipulated by this Court. ORDER

The present writ petition has been filed seeking a mandamus as against the first respondent for re-issuance of the passport based upon the petitioner's application dated 08.12.2025.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in 24 criminal cases. Out of which 23 cases entered in favour of the petitioner.

3. The petitioner has been implicated in a criminal case in Cr.No.404 of 2024 on the file of the second respondent which has culminated in filing of a charge sheet in S.T.C.No.1561 of 2025 on the file of learned Judicial Magistrate, Melur. The petitioner has also been implicated in another criminal case in Cr.No.678 of 2021 on the file of the second respondent which has culminated in filing of a charge sheet in S.C.No.379 or 2022 on the file of Mahila Court, Madurai.

4. In view of the above said facts, the petitioner is directed to approach the Judicial Magistrate Court, Melur, as well as the Mahila Court, Madurai, 2/4

seeking permission of the said Court to go abroad. In case if any such application is filed, the concerned Courts are directed to dispose of the same within a period of 4(four) weeks. Based upon the orders to be passed by the said Courts, the first respondent is directed to proceed in accordance with law.

5. With the above said observations, this writ petition stands disposed of. No costs.
