PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records in Na.Ka. 3126/2016/f1 dated 18.12.2025 passed by R2 and quash the same and further directing the 1st respondent to consider the petitioner's appeal dated 19.11.2025. ORDER

The present writ petition has been filed challenging Form III notice issued by the 2nd respondent Municipality wherein the petitioner's building has been branded as an unauthorised construction and he had been directed to stop construction activities. Otherwise, he has been warned that lock and seal action would be initiated.

2. Considering the fact that the issue relates to unauthorised construction, the petitioner has to file the writ petition before the Division Bench.

3. Preserving the right of the writ petitioner, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed.
