ORDER : The Court Made the following order :- The petitioner/Accused No.9, who was arrested and remanded to judicial custody on 14.05.2015 for the alleged offences punishable under Sections 302 IPC @ 302 r/w 120-B, 212 IPC, in Crime No.467 of 2015 on the file of the respondent police and hence, seeks bail. 2.According to the defacto complainant Mrs.Vasuki, one Miss.Priya daughter of the first accused and Soundarapandi had been in love with each other and they got married about 8 months ago. Consequent of the marriage, the accused had often quarrel with the said Soundarapandi and on 05.05.2015, the accused Nos.1 to 7 armed with lethal weapons attacked the deceased and caused his death. 3.Mr.M.

Ajmal Khan, learned Senior Counsel appearing for the petitioner submitted that the petitioner is a tenant of the first accused and even as per the case of the prosecution, after commission of the offence, the accused had stayed in the petitioner's house and during the stay, he provided food and allowed them to surrender the next day. The learned Senior counsel further submitted that the petitioner is an innocent person and he has been falsely roped in this case. https://hcservices.ecourts.gov.

5. The learned Government Advocate (Crl.side) submitted that due to the love affair, the accused had attacked the deceased brutally and caused his death. It is further submitted that the petitioner had extended financial help to the other accused and also allowed them to stay with him on the date of occurrence. It is further submitted that the prime accused have been already secured and remanded to judicial custody.

6.Considering the overt-act attributed against this petitioner and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Dindigul and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. sd/- 29/06/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
