ORDER : The Court made the following order :- The petitioner/Accused, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 323, 324, 342 and 307 IPC in Crime No.103 of 2023 on the file of the respondent police, 1/4

seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant lodged a complaint against the petitioner herein alleging that due to previous motive, the petitioner herein and other accused have attacked the defacto complainant's son with Aruval and caused severe injuries.

3. The learned counsel appearing for the petitioner submitted that it is a six anticipatory bail petitions and the earlier five petitions filed by the petitioner was dismissed by this Court and seeks anticipatory bail.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit that the petitioner herein is absconding accused. He would further submit that without issuing summons the warrant was issued against him.

5. Considering the facts and circumstances of the case and also considering the fact that without issuing summon warrant was issued against the petitioner by the trial Court, so this Court is inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail in the event of arrest or on his appearance, before the learned Judicial Magistrate, Thirumangalam, Madurai District on 2/4

condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 am until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 06/03/2024 / TRUE COPY / /03/2024 Sub-Assistant Registrar ( C.S.
