ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to measure the land in Survey No.911, Patta No.1082 in Alanda Village, based on the petitioner's request dated 04.08.2025, with police protection.

2. Today, when the matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 and 2 submits that the properties in question are joint family properties. It is further submitted that the second petitioner, during the field inspection, requested the Taluk Surveyor to measure only her share without effecting any partition among the family members. Since it is not appropriate to measure only an individual share in the

absence of partition, the Taluk Surveyor measured only the four boundaries of the properties in question. It is also submitted that if the petitioners file the relevant documents for partition of their shares or approach the competent Civil Court to establish their rights over the subject properties and thereafter file an application for demarcation of boundaries, the same would be considered in accordance with law.

3. Recording the aforesaid submission, this Court finds that the cause of action for the present Writ Petition does not survive and therefore, the Writ Petition stands dismissed. No costs. If the petitioners have any grievance, they are at liberty to work out their remedies in the manner known to law, if so advised. NCC : Yes / No (K.SURENDER, J.)
