Prayer: Writ Petition - filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing Respondents to release and disburse the scheme amount to the petitioner which is deposited under Chief Minister Girl child protection scheme in Receipt No. C94578 by considering the petitioner's representation dated 14.11.2022 and 03.01.2024 within a stipulated time.

ORDER

This writ petition has been filed seeking for issuance of Writ of Mandamus, directing respondents to release and disburse the scheme amount to the petitioner which is deposited under Chief Minister Girl child protection scheme in Receipt No. C94578 by considering the petitioner's representation dated 14.11.2022 and 03.01.2024 within a stipulated time.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader, who takes notice for the respondents. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that the parents of the petitioner were blessed with two female children including the petitioner. Under the scheme of Puratchi Thalaivi Dr.J.Jeyalalitha Girl Child Protection Scheme, which provides financial assistance, the Government has deposed a sum of Rs.4,429/- as fixed deposit for each girl child with the fifth respondent. After attaining the age of 20 years, the applicant can withdraw the same with 10% interest per annum. The petitioner's mother has also applied for the same and it has been periodically renewed. In the meantime, the said scheme was modified by virtue of G.O.Ms.No.67, dated 14.09.2011 and changed the name as Chief Minister's Girl Child Protection Scheme.

4. The further case of the petitioner is that the deposited amount was matured on 24.03.2015. Till now, it was not released, even though the petitioner submitted all the relevant documents. The petitioner made a representation to the respondents to release the aforesaid amount and the petitioner's mother has also sent another representation to the respondents in this regard. Since the said amount has not been released till date, the present writ petition has been filed.

The learned Additional Government Pleader appearing for the respondents submits that the matured amount will be deposited to the beneficiary's account only on receipt of FD receipt, copy of the 10th marksheet, copy of Aadhar, copy of the bank account passbook and ECS mandate form by the beneficiary. The petitioner herein has given her mother's bank account passbook instead of hers. He further submits that once the petitioner gives her correct particulars, the respondents will consider the same and pass appropriate orders for disbursement of the matured amount. He has also produced the written instructions received from the third respondent.

Considering the submissions made by the learned Additional Government Pleader, this Court directs the petitioner to produce all the relevant documents as sought for by the respondents to enable them to pass appropriate orders for disbursement of the matured amount. On receipt of the same, the respondents are directed to immediately consider it and pass appropriate orders for disbursement of the matured amount within a period of eight (8) weeks from the date of receipt of the documents by the petitioner. 4/6
