RESPONDENTS/APPELLANTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the order of this Honourable Court dated 19.01.2018 in SA (MD)No.19 of 2018, so far as relating to possession of suit property by 2nd respondent/Appellant and to declare it as illegal and hand over vacant posession of the suit property within time frame fixed by this Honourable Court.

PRAYER IN SA(MD)No.19 of 2018:

To reverse the decision of the Courts below i.e. made in the suit O.S.No.319 of 2010 Principal Sub Court, Dindigul dated 15.06.2012 confirmed in Appeal A.S.No.28 of 2012 Principal District Court, Dindigul Dated 22.04.2013 and to decree the suit as prayed for and thus allow the Second Appeal with costs throughout. ORDER :This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.S.SIVARAM, Advocate for the petitioner and of MR.M.S.BALASUBRAMANIYA IYYER, Advocate on behalf of the Respondents, the court made the following order:- The learned Counsel for the petitioner seeks permission of this Court to withdraw this petition. Recording the statement of the learned Counsel for the petitioner, this petition is dismissed as withdrawn.
