respondent to conduct the survey based on the old survey number 435/5 and building approval plan.

[Order of the Court was made by DR.G.JAYACHANDRAN, J.] This writ petition has been filed challenging the notice, dated 26.12.2025, issued by the first respondent, under Section 128(1)(a)(b) & (2) of the Tamil Nadu Urban Local Bodies (Amendment) Act, 2022.

2. A perusal of the impugned notice shows that pursuant to the directions issued by this Court vide order dated 11.08.2025 in W.P.(MD) No. 21907 of 2025, a survey has been conducted in Survey Nos.751/2 and 751/3. The petitioner is the owner of the land and building in Survey No.751/3, whereas the land in Survey No.751/2 is classified as a pathway, wherein the petitioner has made encroachment by putting up a construction to an extent

of 355 sq.ft., and the same is now sought to be removed under the impugned notice. This Court finds no merit in this writ petition challenging the impugned notice, which has been issued pursuant to the directions issued by this Court and after due measurement of the field by the surveyor concerned and hence, we are not inclined to entertain this writ petition.

3. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] [K.K.R.K., J.] 29.01.2026 NCC :
