4.T.C.Rajendran ..Respondents PRAYER: Writ Petition is filed under Article 226 of Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records of the Na.Ka.No.281/10/A5, dated 27.07.2011, passed by the 2nd respondent and quash the same and directing the 2nd respondent not to pass any orders till the disposal of the Revision Petition in R.C.No.281/2011, pending on the file of the 1st respondent.

ORDER

This writ petition has been filed by the writ petitioner to quash the proceedings in Na.Ka.No.281/10/A5, dated 27.07.2011, passed by the 2nd respondent and to direct the 2nd respondent not to pass any orders till the disposal of the Revision Petition in R.C.No.281/2011, pending on the file of the 1st respondent. 2.Heard the learned counsel appearing for the petitioner, the learned Government Advocate appearing for the respondents 1 to 3 and the learned counsel appearing for the fourth respondent. 3.Though the petitioner has come forward with this writ petition to quash the proceedings of the 2nd respondent, the grievance of the petitioner before this Court is that the revision petition in R.C.No.281/2011, filed by the petitioner is still https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD).No.8544 of 2011 pending before the first respondent and so far no order has been passed. But, the learned Government Advocate appearing respondents 1 to 3 is not in a position to inform the Court as to whether the aforesaid revision petition is pending before the first respondent or not.

4.In view of the submission by the learned counsel for the petitioner, this Court is inclined to direct the first respondent to expedite the enquiry on the Revision Petition in R.C.No.281 of 2011 and after affording opportunity to both parties, pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that if the final order has already been passed in the revision petition, the first respondent is directed to communicate the order of the same to the concerned parties, forthwith. 5.With the above directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
