PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st 1/6
respondent to reissue petitioner passport No.M555407 dated 19.01.2015 by considering petitioner's passport application No.TR6077351807925 within a stipulated time as may be fixed by this Court. O R D E R
The present writ petition has been filed seeking mandamus as against the first respondent to reissue the passport of the petitioner based upon his application.
2. The learned Government Advocate (Crl.Side) appearing for the respondents 2 to 4 brought to the notice of the Court that as on today, five criminal cases are pending as against the writ petitioner.
3. She further submitted that the petitioner has been implicated in a criminal case in Cr.No.1510/2021 on the file of the Karur Town Police 2/6
Station, which has culminated in filing of charge sheet in S.T.C.No.1801 of 2023 on the file of the learned Judicial Magistrate-I, Karur.
4. She further submitted that the petitioner has also been implicated in another criminal case in Cr.No.1371/2021 on the file of the same police station, which has culminated in filing of charge sheet in S.T.C.No.1788 of 2025 before the same court. Therefore, the petitioner has to approach the concerned trial court seeking permission of the court in both cases to go abroad.
5. She further submitted that the petitioner has also been implicated in another criminal case in Cr.No.710/2021 on the file of the third respondent police station, which has culminated in filing of charge sheet on 12.01.2023 before the same court and it is yet to be taken on file.
6. She further submitted that the petitioner is involved in another criminal case in Cr.No.483/2022 on the file of the third respondent police station, which has culminated in filing of charge sheet on 30.12.2023 3/6
before the same court and it is yet to be taken on file.
7. She further submitted that the petitioner has been implicated in another criminal case in Cr.No.06/2022 on the file of the second respondent police station, which is under investigation.
8. Considering the abovesaid facts, the petitioner is directed to approach the learned Judicial Magistrate-I, Karur seeking permission of the court in S.T.C.Nos.1801 of 2023 and 1788 of 2025 to go abroad. In case such application is filed, the same shall be disposed of within four
(4) weeks from the date of application. Depending on the orders to be passed by the concerned trial court, the first respondent is directed to proceed in accordance with law.
9. With the said observations, this Writ Petition is disposed of. No costs.
