722 of 2025) PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents more particularly the 2nd respondent to register the settlement deed as executed in favour of petitioner's daughters under reference vide RFL/Alangulam/ 80/2024 dated 26.12.2024 by him in respect of his property bearing Survey Nos.361, 362/1 and 363/2 situated at Alangulam Village, Tenkasi District, measuring to an extent of 0.61.5 hectare and 0.66.0 hectare forthwith. 1/5

ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 2nd respondent to register the settlement deed as executed in favour of petitioner's daughters under reference vide RFL/Alangulam/ 80/2024 dated 26.12.2024 by him in respect of his property bearing Survey Nos. 361, 362/1 and 363/2 situated at Alangulam Village, Tenkasi District, measuring to an extent of 0.61.5 hectare and 0.66.0 hectare forthwith. 2.The learned Counsel appearing for the 3rd respondent submitted that already a suit is filed and a declaration and injunction is acting against the petitioner. By concealing all these facts, the petitioner has filed the present writ petition without impleading the appropriate parties. The said submission is recorded. The learned Counsel appearing for the 3rd respondent further submitted that there are several other persons who ought to be heard while conducting the enquiry for which he is relying on the patta issued to other persons. 3.This Court without expressing any opinion on merits is directing 2/5
the 1st respondent to conduct an enquiry after issuing notice to the petitioner, 3rd respondent and other rival claimants. The 3rd respondent is directed to furnish the list of the other claimants and particulars before the official respondents. Thereafter, the official respondents shall consider the petitioner's claim after conducting an enquiry by issuing notice to the petitioner, 3rd respondent and other rival claimants and pass orders in accordance to law. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
