respondents to pass order re-fixing petitioner pay and terminal benefits and further to pay the difference amount in wages and difference amount in permanent benefits.

ORDER
The petitioner is working as a Driver in the respondent Transport Corporation. While he was on duty, he caused an accident, for which, a departmental proceedings was initiated against him and he was imposed with a punishment of extension of daily wage service for a period of one year. Further, a criminal case was also registered as against the petitioner and the same was taken on file in C.C.No.542 of 2011 on the file of the Judicial Magistrate Court No.II, Madurai. After full-fledged trial, the petitioner was honorably acquitted from the charges, by Judgment dated 26.07.2022. By referring the Judgment of acquittal dated 26.07.2022, the petitioner has submitted a representation to the respondents on 05.10.2022, requesting to grant him monitory and promotional benefits by cancelling the order of punishment. However, there was no response 2/5
on the said representation. Therefore, the petitioner has filed a writ petition before this Court in W.P.(MD)No.30786 of 2024 and the same was allowed by this Court by order dated 09.12.2024, with a direction to the respondents to consider the petitioner's representation. However, the 2nd respondent, by order dated 17.03.2025, rejected the request of the petitioner. Challenging the same, the petitioner has filed this writ petition.

The petitioner, by referring the Judgment of honourable acquittal from the criminal charges, has made a request to the respondents to cancel the order of punishment and grant him monitory and promotional benefits. An honourable acquittal in a criminal case cannot be a ground for quashment of the punishment order. As against the order of punishment, the petitioner is having a remedy before the Labour Court under the Industrial Disputes Act. Therefore, the petitioner is at liberty to workout his remedy before the concerned Labour Court under the Industrial Disputes Act.
