Respondent/Respondent PRAYER: Criminal Original Petition is filed under Section 439(1)(b) of Cr.P.C, to modify the condition, imposed upon the petitioner in Cr.M.P.No.4170 of 2020 on the file of the Judicial Magistrate No.II, Sivagangai, directing the petitioner to execute the blood relative surety by order, dated 11.12.2020.

ORDER

This petition has been filed seeking modification of the condition, imposed upon the petitioner in Cr.M.P.No.4170 of 2020 on the file of the Judicial Magistrate No.II, Sivagangai, directing the petitioner to execute the blood relative surety by order, dated 11.12.2020.

2.The learned counsel for the petitioner submitted that since the petitioner is not having any blood relative, he is not in position to comply the condition imposed by the trial Court. 3.Such sort of prayer cannot be sought before this Court directly. The petitioner has to approach the concerned Court. Without approaching the concerned Court, the petitioner has directly approached this Court.

4.In view of the same, this Criminal Original Petition is dismissed with liberty to approach the concerned Court by setting out the circumstances of the petitioner.
