ORDER

The petitioner has filed this petition seeking a direction to the second respondent not to harass the petitioner under the guise of enquiry. 1/4

2.The contention of the petitioner is that the petitioner is working as an Assistant Security Officer in National Co-operative Sugar Mills Ltd.. He is being called for enquiry by the respondent police, despite the petitioner disclosing all the facts known to him and gave his explanation in a case relating to theft of goods in the Mill. He further contended that for no reason, the petitioner is being unnecessarily called for enquiry and harassed. Hence, this petition.

3.The learned Additional Public Prosecutor appearing for the respondent police submits that the case in Crime No.167 of 2024 is being enquired by the first respondent police and the petitioner being an employee of the Sugar Mill is called for the purpose of investigation. As on the date, the petitioner is not an accused in this case. The investigation in case in Crime No.167 of 2020 is under progress. 4.Considering the facts and circumstances of the case and considering the submission made by the learned counsel for the petitioner petitioner, this Court directs that if the petitioner is required for enquiry, notice shall be issued to the petitioner and on receipt of the same, the petitioner shall appear before the respondent police for enquiry.

5.With the above direction, this Criminal Original Petition is disposed of.
