ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-5 in Crime No.463 of 2015 on the file of the respondent police surrendered before the learned Judicial Magistrate on 16.04.2015 for the alleged offence under Sections 147, 148 and 302 of I.P.C and hence seeks bail.

2. The case of the prosecution is that on 13.04.2015, the deceased was attacked by the accused with lethal weapons and done to death.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. It is further submitted that the petitioner has been in judicial custody for more than 75 days.

4. Per contra, the learned Government Advocate(Crl. Side) submitted that both the accused and the deceased are rowdy elements and they are history sheeted rowdies and on 13.04.2015, due to previous enmity, the accused attacked the deceased with lethal weapons. He further submitted that major part of the investigation is over and the petitioner has no bad antecedents. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the stage of investigation and the incarceration of the petitioner, this Court is inclined to enlarge the petitioner

on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Madurai, and on further condition that the petitioner shall appear before the respondent police daily twice i.e., at 10.00 a.m and 5.00 p.m until further orders.
