( IN CRIME NO. 51 OF 2018) ...3RD RESPONDENT/COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to cancel the anticipatory bail granted in Crl.OP(MD)No. 22239/2018 dated 20.12.2018 and consequently direct the 3rd respondent to investigate in detail and dismiss the Criminal Original Petition Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.H.THAYUMANASWAMY, Advocate for the petitioner and of MR.K.SUYAMBULINGA BHARATHI, Advocate for the Respondent, the court made the following order:- This petition is filed to cancel the anticipatory bail granted in Crl.O.P.(MD)No.22239 of 2018, dated 20.12.2018 by this Court on the ground that the petitioner was not aware, when the anticipatory bail application was moved by the accused persons, despite the petitioner is making regular visit to the police station and has enquired about the status of the case.
2.The learned counsel appearing for the petitioner would submit that the entire Sreedhana articles of the petitioner are with the respondents and seeks to hand over the same to the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 3.Under such circumstances, this Courts feels that this prayer cannot be entertained in this petition. Taking into consideration
that the petitioner is being a lady, who has lost her life and the jewels and other articles belonging to the petitioner are in custody of the respondents, the petitioner is directed to approach the respondent police, seeking to take necessary steps for issuance of summons to the respondents / accused in this case to retrieve and restore the articles of the petitioner.
