ORDER

This Criminal Original Petition has been filed seeking to relax the condition (ii) imposed on 23.09.2024 in Crl.M.P.No.1102 of 2024 by the learned Principal District and Sessions Judge, Karur.

2. Mr. M.Vivek, learned counsel appearing for the petitioner, submits that the petitioner has substantially complied with the condition. He further submits that the petitioner is residing at Thiruvaiyaru, Thanjavur District and he is facing difficulty in coming to Karur and sign before the learned Judicial Magistrate Additional Mahila Court, Karur, daily at 10.30 am. Hence, he prays for relaxation of the said condition.

3. Per contra, Mr.B.Prasanna, learned counsel appearing for the respondent, submits that if the condition is relaxed, the petitioner will abscond.

4. Considering the facts and circumstances of the case, this Court is inclined to relax the condition (ii) imposed on the petitioner by the learned Principal District and Sessions Judge, Karur, in Crl.M.P.No.1102 of 2024 vide order dated 23.09.2024. 2/4

Accordingly, the condition (ii) imposed by learned Principal District and Sessions Judge, Karur, in Crl.M.P.No.1102 of 2024, dated 23.09.2024, is hereby relaxed subject to condition that the petitioner shall surrender his original passport to the learned Judicial Magistrate Additional Mahila Court, Karur, within 10 days from the date of receipt of a copy of this order. The other conditions shall hold good.
