ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 379 IPC r/w Section 21(4) of the Mines & Minerals (Development & Regulation Act 1957) in Crime No.4 of 2021 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the petitioners illegally transported one unit of river sand Hence, the present complainant. 3.The learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that the petitioners have not transported river sand. Hence, he prayed for grant of anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD)No.642 of 2021 4.The learned Government Advocate (Crl. Side), appearing for the respondent police submitted that the second petitioner in this case has three previous cases. He produced a report of the Village Administrative Officer. It is seen from the report that the accused persons illegally transported river sand. Hence, he opposed to grant anticipatory bail to the petitioners.

5.In view of the above, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this criminal original petition is dismissed.
