(MD).No.317/2017 dated 16.08.2017.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.K.SAMIDURAI, Advocate for the petitioner and of Mr.K.K.RAMAKRISHNNAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- It is seen that the petitioner was granted bail by this Court, by order dated 16.08.2017, in Crl.A.No.317 of 2017, on certain conditions, one of which is that (*)the petitioner should report before the committal Court on the first working day of every English Calendar month at 10.30 a.m., till the disposal of the appeal or until further orders.

2. The petitioner has filed the present petition seeking for relaxation of the bail conditions.

3. The learned Additional Public Prosecutor on instructions submitted that the petitioner has been complying with the conditions till date.

4. However, this Court is of the view that the aforesaid condition cannot be completely relaxed because pending disposal of the appeal the petitioner must appear before the trial Court once in a month so that if the appeal is dismissed, the petitioner will have to be taken into custody. appear before the Trial Court on any day, he shall make arrangements to file an application under Section 317 Cr.P.C., and shall appear before the Trial Court on any other day in lieu of the date of his absence, as directed by the Trial Court.
