O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the third respondent to consider the petitioner's representations dated 10.09.2025 and 16.12.2025 and consequently issue patta in favour of the petitioner and the other legal heirs in respect of their respective shares of land, measuring an extent of 56 cents, comprised in Survey No.220/2B1, situated at Kulasekarapattinam Village, Tiruchendur Taluk, Thoothukudi District, based on the registered Partition Deed bearing Document No.3376 of 2022 dated 09.12.2022, within a time frame to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

3. The case of the petitioner is that the subject property originally belonged to the petitioner's father. After the demise of the petitioner's father, the petitioner and the other legal heirs succeeded to the said property. A registered Partition Deed dated 09.12.2022 was executed among the seven legal heirs allotting 8 cents each and all the parties are in exclusive possession and enjoyment of their respective shares. However, the patta stands in the name of one co-sharer, namely Chidambaravadivu, excluding the petitioner and the other sharers. Though the petitioner submitted representations dated 04.08.2025 and 16.12.2025 and also made an online application dated 03.12.2025 before the third respondent seeking mutation of patta, no action has been taken thereon. Therefore, the petitioner has been constrained to file the present Writ Petition.

The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representations dated 04.08.2025 and 16.12.2025 and the application dated 03.12.2025 would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representations dated 04.08.2025 and 16.12.2025 and the application dated 03.12.2025 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The said representations shall be considered and disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner and any other interested parties who may be affected by the decision. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. There shall be no order as to costs.
