ORDER

The petitioner is the defacto complainant seeking to challenge the summons, the present petition has been filed.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent and perused the records.

3. The learned counsel appearing for the petitioner submitted that for the past few years the accused has not appear before the trial court. He further submitted that due to improper indication, the petitioner could not appear before the court on the hearing date and also submitted that he is ready to cooperate with the trial on the next date of hearing.

4. Considering the same, the summons issued in C.C.No.200 of https://hcservices.ecourts.gov.in/hcservices/ 2006 and in S.T.C.No.262 of 2015 on the file of the learned District Munsif-cum-Judicial Magistrate, Thirumayam, Pudukottai District is set aside, subject to the condition that the petitioner shall

cooperate to conduct the trial by appearing on the next date of hearing. Failing which, the summons issued will automatically revoked.
