This Civil Miscellaneous Petition, under 41 Rule 3A r/w order 43 1 of as Rules has been filed to condone the delay of 858 days in filing the Second Appeal against the Judgment and Decree dated 06.02.2013 made in A.S.No.6 of 2013 on the file of the Subordinate Court, Devakottai.

Prayer in SA(MD) No.SR3354 of 2016:

This Appeal is sought to be filed under Section 100 of C.P.C., to allow the second appeal and set aside the decree and Judgment dated 06.02.2013 made in A.S.No.6 of 2013 on the file of the Subordinate Court, Devakottai confirming the Judgment and decree dated 16.08.2012 made in O.S.No.38 of 2008 on the file of District Munsif cum Judicial Magistrate, Karaikudi.

ORDER : This petition having been posted for orders on this day, for not having represented the batta with petition alongwith affidavit regarding R1 and R2, in the presence of Mr.C.NAGAMUTHU, Advocate for the petitioner and this Court having granted time till 14.09.2017, for compliance of the defects, as condition precedent and the said Advocate, not having complied with the said direction of this Court, it is ordered that this petition do stand dismissed against the respondents 1 and 2.
