PRAYER:This Second Appeal has been filed under Section 100 of Civil Procedure Code, against the judgment and decree, dated 29.10.2004 passed in A.S.No.50 of 2004 on the file of the Subordinate Court, Devakottai, confirming the judgment and decree, dated 28.07.2004 passed in O.S.No.39 of 2003 on the file of the District Munsif Court, Devakottai.

J U D G M E N T

When the matter was taken up for hearing on 29.01.2021, the learned counsel for the appellant submitted that he has already filed a memo to the effect that he has no instructions from the appellant and he reported "No Instructions" before this Court. Hence, this Court ordered notice to the appellant and notice was served on the appellant.

2.Today, when the matter is taken up for hearing, there is no representation for the appellant. In view of the same, this Second Appeal is dismissed for non-prosecution. No costs.
