Prayer :- Criminal Original Petition filed under Section 438 of Criminal Procedure Code, praying this Court to enlarge the Petitioner on bail in the event of his arrest in Crime No. 4 of 2021 on the file of the respondent Police.
ORDER:- Criminal Original Petition coming upon for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.R.J.Karthick, Advocate for the Petitioner and of Mr.K.Suyambulinga Bharathi, Government Pleader (Criminal Side) on Behalf of the Respondents, this Court made the following order:
The petitioner/Accused No.6, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 379 I.P.C, in Crime No.4 of 2021, seeks anticipatory bail.
2. Heard both sides.
3. On going through the entire complaint, it is seen that the offence under the Mines and Minerals Act whould not attract. It is seen that A1 to A5 had been arrested and let out on station bail by the Investigation Officer. The Division Bench of this Court had clearly given certain directions to deal with cases in Mines and Minerals Act, based on which, the Government issued a G.O. giving https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.637 of 2021 effect to the same. Despite the same, A1 to A5 have been granted station bail.
4.In view of the same, the Investigation Officer is to be present in this regard on 10.02.2021 along with Case Diary. Post the matter on 10.02.2021.
