PRAYER:

FOR BAIL IN CRIME NO.972/2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioner / Accused No.1, who was arrested and remanded to judicial custody from 03.12.2023, for the offence punishable under Sections 25(1A) of the Arms Act, 1959 in Crime No.672 of 2023, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of deadly weapon and the same was recovered by the respondent Police. 1/3

Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has not committed any such offence as alleged by the prosecution. He would further submit that the petitioner is ready to abide by any conditions imposed by this Court. Hence, he prays for bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that totally eight previous cases are pending against the petitioner, out of which, two cases are under 302 I.P.C. offence and one case is under 307 I.P.C. offence and remaining cases are under the Arms Act. Hence, he vehemently opposes for grant of bail to the petitioner herein.

5. Considering the above facts and circumstances of the case and also considering the previous antecedents are reported against the petitioner, this Court is not inclined to grant bail to the petitioner.
