RESPONDENT/ RESPONDENT/ RESPONDENT Criminal Miscellaneous Petition filed under Section 482 of Criminal Procedure Code, praying that in the circumstances stated therein and in the affidavit filed therewith The High Court will be pleased to extend the time to deposit of a sum of Rs.2 Lakhs to the credit of the Learned Additional Chief Judicial Magistrate, Madurai in M.C.No.30 of 2014 as per the order in Crl.M.P.(MD).1115/2018 in Crl.O.P.(MD).No.7102 of 2015 dated 19.02.2018 for further period. PRAYER in CRL OP(MD) No.7102 of 2015:

To set aside the impugned order dated 22.01.2015 in Cr.M.P.No.2163 of 2014 in M.C.No.30 of 2014 on the file of the learned Additional Chief Judicial Magistrate, Madurai. Order : This petition coming on for hearing on this upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.R.SHANKAR GANESH, Advocate for the petitioner, this court made the following order:- This matter is listed today under the caption "for reporting compliance".

2.This Court, by the order dated 20.12.2017 has passed a conditional order in Crl.OP.(MD)No.7102 of 2017 directing the petitioner herein, to deposit a sum of Rs.2 lakhs to the credit of M.C.No.30 of 2014 on the file of the learned Additional Chief Judicial Magistrate, Madurai, within a period of four weeks from the date of receipt of copy of the said order and on such deposit, the respondent is at liberty to withdraw the amount without any security. The learned counsel for the petitioner has submitted that now the petitioner instead of depositing the amount before the trial Court, has taken a demand draft for a sum of Rs.2 lakhs in the name of the respondent and hence, he seeks further time for changing the demand draft.

3.Considering, the order of this Court dated 20.12.2017, since a liberty is given to the respondent to withdraw the amount, the petitioner is directed to hand over the demand draft to the respondent directly on or before 13.03.2018 and after handing over the demand draft to the respondent, the petitioner has to surrender before the trial court and file a petition to re-call the warrant and on such filing of the application, the trial court has to consider and dispose of the said application on the same day without further adjournment.
