Aggrieved by the same, the Madurai Corporation filed W.A.(MD)No.562 of 2022. The said Writ Appeal was dismissed. However, certain observations were made in favour of the Corporation. However, it was observed that it is open to the Corporation to insist for a deposit of a sum of Rs.50,000/- in case, no amount is due from Aavin. The petitioner had remitted a sum of Rs.50,000/- with Aavin.
3. Today, it is conceded by the learned standing counsel for Aavin that this amount would be passed on to the Corporation within a period of two weeks.
4. Recording the said undertaking, the third respondent is directed to remit a sum of Rs.50,000/- paid by the petitioner. It is meant to be the non-refundable deposit in favour of the Corporation. Now that the issue regarding payment has been settled, the Madurai Corporation is directed to scrupulously comply with the direction already given by this Court on 23.09.2021. The entire exercise shall be completed before the end of this month.
