Despite direction by this Court to the learned Government Advocate to serve private notice to the first respondent returnable by 16.09.2021, no notice has been issued by the learned Government Advocate. This is a case, where, the learned counsel on record for the first respondent has reported that the first respondent has handed over the bundle to the learned counsel for the first respondent before the lower Court and that the first respondent has not engaged any other counsel to conduct his case. 2.Hence, this Court is of the view that the Writ Petition can be disposed of only in the presence of the first respondent.
In the absence of the learned Government Advocate or the Writ Petitioner or the learned counsel for the first respondent, to give proper intimation to the first respondent about the hearing of this case, this Court has no other option, except to direct the Registry to send a letter intimating the first respondent to appear before this Court on 08.10.2021. The learned Government Advocate is also requested to send private notice to the first respondent returnable by 08.10.2021.
3.Post this matter on 08.10.2021 Whereas it is expedient in the interest of justice that the personal appearance of the aforesaid person, is necessary before the Madurai Bench of Madras High Court, Madurai, at 10.30 A.M on 08/10/2021.
