ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 316(4), 336(2), 336(3), 340(2), 344, 318(2), 318(4) and 49 of BNS (hereinafter referred to as new penal code) in Crime No.725 of 2024 on the 1/3

file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner's husband was working as a Supervisor in the partnership firm. He is said to have misappropriated a sum of Rs.43.21 Lakhs, which was supposed to be collected towards the payment of ESI and PF dues and the petitioner is his wife. The petitioner lost her husband in the year 2024. The allegation against the petitioner is that she managed to transfer a sum of Rs.1.51 Lakhs to her account from the account of her husband.

3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent police.

4. Taking into consideration the facts and circumstances of the case, there shall be a direction to the respondent police to resort to the procedure adumbrated under Section 35 of BNSS Act and call the petitioner for enquiry and complete the investigation as expeditiously as possible.
