PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to call for the records in C.C.No.249 of 2014 on the file of the learned Judicial Magistrate No.II, Dindigul, Dindigul District and quash the proceedings as against the petitioner.

O R D E R

This petition has been filed to quash the proceedings in C.C.No.249 of 2014 on the file of the learned Judicial Magistrate No.II, Dindigul, Dindigul District.

2.The learned counsel for the complainant would submit that on the jurisdiction point the compliant has been returned from the learned Judicial Magistrate No.II, Dindigul to represent the same before the concerned jurisdictional Magistrate Court. 3.However, the respondent/defacto complainant failed to represent the same before the jurisdiction Magistrate Court instead of that he filed a suit for recovery of money as against the petitioner herein in O.S.No.103 of 2015 on the file of the Subordinate Court, Mettur and it is subsequently, transferred to Subordinate Court, Omalur and it is pending. Therefore, quashing of C.C.No.249 of 2014 become infructuous.

4.Recording the same, the Criminal Original Petition is dismissed as infructuous. Consequently, connected Miscellaneous Petitions are also dismissed.
