Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.N.BALASUBRAMANIAN, Advocate for the petitioner and of MR.M.VAIKKAM KARUNANITHI, Government Advocate (Crl.Side) on behalf of the Respondent, the court made the following order:- This petition has been filed to direct the Judicial Magistrate, Pattukkottai to return back the passport bearing No.S5251182 to the petitioner which was surrendered in Crime No.334 of 2016 on the file of the Judicial Magistrate, Pattukkottai, as per direction in Crl.O.P.(MD)No.4526 of 2022, dated 18.03.2022. 1/3

2.The learned counsel for the petitioner would submit that since the petitioner was acquitted by the trial Court, he seeks direction to the Judicial Magistrate, Pattukkottai to return back the passport bearing No.S5251182 to the petitioner. 3.The above submission is admitted by the learned Government Advocate (Crl.Side) appearing for the respondent police.

4. In view of the above submission, this petition is allowed and the Judicial Magistrate, Pattukkottai, is directed to return back the passport bearing No.S5251182 to the petitioner.
