For Respondent : Mr.Ss.Madhavan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.159 of 2019 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 341, 294(b), 387, 307 and 506(ii) of IPC, in Crime No.159 of 2019, seeks anticipatory bail.
2. The learned counsel appearing for the petitioner would submit that on 28.12.2021, due to illness, the petitioner was not able to appear before the learned Judicial Magistrate, Srivaikundam, in respect of the case in P.R.C.No.51 of 2020 and hence, non bailable warrant has been issued against the petitioner. He would further submit that the said absence is neither willful nor wanton and he undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail.
3. The learned Government Advocate(Crl.side) would submit that the non bailable warrant has been issued against the petitioner on 28.12.2021 and the same is pending.

4. Considering the facts and the circumstance of his case, the petitioner is directed to approach the committal Court to recall NBW already issued against him.
