ORDER
This Civil Revision Petition has been filed seeking a direction to dispose of the appeal in A.S.No.15 of 2022 pending on the file of the learned Sub Court, Pattukottai within a time stipulated by this Court.
2. According to the revision petitioners, the respondent filed a suit for declaration and injunction in O.S.No.240 of 2015 before the District Munsif Court, Pattukottai. After trial, the suit was dismissed on 30.11.2020. Thereafter, the respondent has filed an appeal in A.S.No.15 of 2022. The petitioners are ready for arguments. But the respondent is wantonly getting adjournment to protract the litigation. Hence, the present revision petition.
3. Heard the learned counsel appearing for petitioner. Since the revision is filed for seeking early disposal, no notice is necessary to the respondent.
4. Having been taken into consideration of the material facts and circumstances, this Court is of the view that in the interest of justice, a 2/4
direction may be issued to the learned Sub Court, Pattukottai, to dispose of the appeal as expeditiously as possible.
5. Accordingly, this Civil Revision Petition stands disposed of with a direction to the learned Sub Court, Pattukottai to dispose of the appeal in A.S.No.15 of 2022 pending on his file, within a period of three
(3) months from the date of receipt of a copy of this order on merits and in accordance with law. There shall be no order as to costs. 22.01.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR To The Sub Court, Pattukottai.
