For Respondent : Mr.R.Suresh Kumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.202 of 2023 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/Accused No.1, apprehending arrest at the hands of the 1/3

respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 435, 341, 342, 323, 324 and 307 I.P.C., in Crime No.202 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 17.09.2023 in the morning, while the defacto complainant and others consuming liquor, in a drunken mood, there was scuffle between them and that was carried on at about 9.30 p.m., the same occurrence said to have taken place. Over the above said scuffle, the accused persons came to that place with two petrol bombs, hurled the same on the defacto complainant and others, one of the bomb exploded and another did not. Thereafter, the defacto complainant was attacked using stick, sickle and he was admitted in the hospital. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent and never participated in such occurrence. He has been falsely implicated in this case.

4. The learned Additional Public Prosecutor would submit that the anticipatory bail applications filed by the petitioner was dismissed by this Court.

5. Considering the considering the manner, in which, the offences said to have taken place, there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. I find no change of circumstances to entertain this 2/3
