ORDER

This Civil Miscellaneous Petition has been filed to condone the delay of 230 days in filing the Appeal Suit in A.S.(MD)SR No.90465 of 2024 before this Court.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The learned counsel for the respondent has raised only formal objection to this petition.

4. Being satisfied with the reasons stated in the affidavit, and also considering the duration of delay, this Court is inclined to allow this petition on payment of cost. Accordingly, this Civil Miscellaneous Petition is allowed on payment of cost of Rs.1,000/- (Rupees One Thousand only) by the petitioner to the respondent, within a period of one week from the date of receipt of a copy of this order, failing which 2/4

this petition shall stand automatically dismissed without any further reference to this Court.
