PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, direct the 2nd respondent to cancel the patta issued in favour of the 5th respondent for S.No.391/12-0.04.0 ares of Melur Village, Thirumayam Taluk and Pudukkottai District at once.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed this writ petition seeking a direction to the 2nd respondent to cancel the patta issued in favour of the 5th respondent in S.No.391/12-0.04.0 ares of Melur Village, Thirumayam Taluk and Pudukkottai District 2.Mr.J.Ashok, learned Additional Government Pleader, accepts notice for the respondents 1 to 4. In view of the order proposed to be passed in this writ petition, notice to the fifth and sixth respondents is dispensed with.

3.By consent of both parties, this writ petition is taken up for final disposal at the time of admission itself. 4.According to the writ petitioner, the land is classified as Ryotwari manai. It is his case that the said land is a vacant site, which has been used by the villagers for organizing cultural events, sports 2/5

activities, and other allied functions, particularly during the Mariammal Temple festival and the New Year. It is alleged that patta has been issued in favour of the fifth respondent. Aggrieved by the same, the petitioner seeks cancellation of the patta granted in favour of the fifth respondent. 5.We are of the considered view that, in the present writ petition, the petitioner seeks to espouse a private interest rather than any genuine public interest. If at all any patta is granted to the fifth respondent, the proper way for the petitioner is to file an appeal before the authorities concerned and work out his remedy. Hence, we are not inclined to entertain this writ petition.

6.Accordingly, the writ petition is dismissed. There shall be no order as to costs.
