ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 447, 294(b), 324, 307 and 506(ii) IPC and Section 3 of TNPPDL Act, in Crime No.180 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that there is a land dispute between the de-facto complainant and one Chermadurai as a result of that the accused attacked de-facto complainant.
3. It is submitted by the learned Government Advocate (Crl.side) that the injured person had already been discharged from the hospital. She further submits that totally five accused involved in this case and the investigation is going on.
4. Considering the submissions made by the learned Government Advocate (Crl.side) and also considering the fact that the injured person had already been discharged from the hospital, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
5. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate, Nanguneri, Tirunelveli District, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each https://hcservices.ecourts.gov.in/hcservices/
for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. for period of three weeks and thereafter as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.
