Respondents 2 to 13/Defendants 2 to 12 PRAYER:- This Civil Revision Petition has been filed under Article 227 of the Constitution of India, to direct the Sub Court, Kulithalai, Karur District to dispose of the Original Suit in OS.No.195 of 2019 on the file of the Sub Court, Kulithalai, Karur District as expeditiously within time frame as may be fixed by this Court by allowing this Revision Petition. ORDER

The petitioner is the first defendant in O.S.No.195 of 2019 which has been filed for declaring the compromise decree dated 11.10.2018 in O.S.No. 13 of 2018 is null and void and for permanent injunction restraining the petitioner herein, her men, agents and any other persons claiming under their authority from interfering with the first respondent's peaceful possession and enjoyment of the suit property.

2.It is submitted that the petitioner is the Senior Citizen and aged about 72 years and the petitioner is only the contesting respondent/defendant in the above suit. It is submitted that appropriate direction may be issued to the Sub 2/4

Court, Kulithalai, Karur District, to dispose the OS.No.195 of 2019 within a time frame as may be fixed.

3.The certified copy of the 'B' diary indicates that D2 & D5 were set ex-parte and fresh summons were issued to D6 & D7 on 17.08.2022. There are totally 12 defendants. Out of which, 4 of them are the Government Authorities from the Revenue Department.

4.The present Civil Revision Petition stands disposed of at the time of admission without expressing any opinion on the merits of the case considering the fact that no adverse orders proposed to be passed against the respondents, who are the defendants in the suit.

5. The prayer sought for in this petition is only for direction to dispose the OS.No.195 of 2019 pending before the Sub Court, Kulithalai, Karur District.

6. Considering the above, there shall be a direction to the Sub Court, Kulithalai, Karur District, to dispose OS.No.195 of 2019 preferably within a period of 12 months from the date of receipt of service of summons or from the last date on which any of the defendant/respondent set ex-parte. 3/4
