Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is the sole accused, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406, 468 and 420 of I.P.C., in Crime No.7 of 2012 on the file of the respondent police and hence, seeks anticipatory bail.

2. The Assistant Director of Panchayat preferred a complaint alleging that the petitioner, who is functioning as a President of the Panchayat, has misappropriated Rs.80,590/-.

3. The learned counsel for the petitioner submitted that the petitioner is a poor lady and she has been the President of the Panchayat for the past two terms and she has been falsely implicated in this case. The learned counsel for the petitioner further submitted that to show her bona fide, the petitioner is ready to deposit Rs.50,000/- to the credit of the Crime No.7 of 2012 without prejudice to her rights in the criminal case.

4. The learned Government Advocate (Crl.side) submitted that the investigation has been completed and the charge sheet has also been filed.

5. Considering the submission of the learned counsel, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of her arrest or on her appearance before the learned Judicial Magistrate, Ilayankudi and on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) to the credit of Crime No.7 of 2012 and on further condition that the petitioner shall appear before the respondent police as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
