RESPONDENT/RESPONDENT/ COMPLAINANT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the order which already passed in Crl.OP(MD)No.2864 of 2019 dated 25.02.2019.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.A.UTHAYAKUMAR, Advocate for the petitioner and of MR.K.SUYAMBULINGA BHARATHI, Government Advocate (Crl. Side) on behalf of the Respondent,the court made the following order:- This petition has been filed to modify the order passed in Crl.O.P(MD)No.2864 of 2019 on 25.02.2019.

2.At the time of hearing the criminal original petition, the prosecution has clearly stated that a charge sheet has been filed before the Court concerned and upon hearing the said submission made by the prosecution, this Court dismissed the bail petition with a direction to the Court to complete the trial within a period of six months from the date of a receipt of a copy of this order.

3. Thereafter the learned counsel for the petitioner filed copy application to the concerned court for getting charge sheet copies and the same was returned with endorsement by stating that no charge sheet has been filed in the above criminal case. Therefore the petitioner has approached this Court for relief as stated supra.

3. Considering the facts and circumstances of the case and alsos considering the submissions made by the learned counsel for the petitioner, this petitioner is ordered and the order in Crl.O.P.(MD)No.2864 of 2019 is recalled and restored to file. sd/- 21/03/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
