PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS directing the 5th Respondent to issue the Renewal Passport of the Petitioner's son Namely Harun Al Rasith in Renewal Application No.DEI471910374125, Dated 04.03.2025 based on the petitioner's representation dated 04.12.2025 within the time that may be stipulated by this Court.

ORDER
The present writ petition has been filed by the father of the passport applicant seeking a mandamus as against the 5th respondent for renewal of the passport based upon his application dated 04.03.2025.
2. A perusal of the records indicate that the petitioner's son's passport has expired on 05.03.2025 and as on today, he is in Dubai. The petitioner's son has been implicated in a criminal case in Cr.No.164 of 2017 on the file of the Uchipuli Police Station, Ramanathapuram, which has culminated in filing of a charge sheet before the learned Judicial Magistrate No.II, Ramanathapuram in PRC.No.100 of 2025 which is yet to be committed to the Sessions Court. 2/4

In view of the expiry of the passport, the petitioner is directed to approach the 3rd respondent seeking emergency certificate to land in India and after landing in India, the petitioner is directed to approach the concerned trial Court seeking permission of the Court to go abroad. Based upon the orders to be passed by the trial court, the 5th respondent is directed to pass orders in accordance with law.
4. With the above said observations, this writ petition stands disposed of. No costs.
