FOR BAIL IN CRIME NO.1209 OF 2023 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- 1/3

The petitioner, who was arrested and remanded to judicial custody on 26.11.2023 for the offences punishable under Sections 394 and 414 of I.P.C., in Crime No.1209 of 2023, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that on 10.10.2023, when the defacto complainant returned back to her home, at that time, the petitioner and other accused persons drove the bike and snatched the defacto complainant's five sovereigns of gold and caused injuries to her. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that based on the confession statement only, the petitioner has been falsely implicated in this case. He would further submit that there is no previous case pending against the petitioner. Hence, he prays for bail.

4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that the investigation is pending. He would further submit that the petitioner has also involved in this case. He would further submit that the petitioner gave signal to the other accused persons and after that only, the other accused snatched the defacto complainant's chain. Accordingly, he prays for dismissal of this petition.

5. Considering the facts and circumstances of the case and also considering the 2/3

gravity of offences and also considering the previous antecedents, this Court is not inclined to grant bail to the petitioner herein.
