This Second Appeal is filed under section 100 of Civil Procedure Code, to set aside the Judgment and Decree dated 22.3.2005 in AS.197/2004 on the file of the Learned Principal District Judge, Madurai confirming the Judgment and Decree dated 30.4.2004 in OS.201/1996 on the file of the Learned Subordinate Judge, Periyakulam,and set aside the same .

ORDER : This petition coming on for hearing on this day, upon perusing the petition and the affidavit filed in support thereof and the earlier Order of this Court, and upon hearing the arguments of Mr. M.A.M.RAJA, Advocate for the petitioner and of Mr.JAWAHAR Advocate for the Respondent , this court made the following order:- "Heard both sides.
