PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd Respondent to forward the Revised Family Pension Proposal as per the 6th and 7th Pay Commission concerning the Petitioner's family pension in PPO.No.333645/VAS to the 1st Respondent and direct the 1st Respondent to pay the Petitioner her entitlement including the arrears of the revised pension with interest, within a time to be stipulated by this Court.

ORDER

The instant Writ Petition has been filed by the wife of a deceased Government Servant, seeking a direction as against the second respondent to forward the revised family pension proposal.

2. A perusal of the records reveal that the petitioner's husband was working as Village Assistant and he had attained superannuation on 31.03.2007, and he was passed away on 10.01.2008. Thereafter, the petitioner was receiving the family pension as per fifth pay commission recommendations. The petitioner has given a representation to the third respondent herein, seeking revision of his family pension, based upon the sixth and seventh pay commission recommendations. The third respondent has addressed a communication to the second respondent on 21.02.2024, requesting the second respondent to send a revised family pension proposal. The petitioner has also given a representation to the second respondent on 19.03.2024, seeking revised family pension proposal along with statutory form. However, the second 2/4

respondent has not forwarded the revised family pension application to the third respondent. Hence, the present writ petition has been filed.

3. Considering the above said facts, the second respondent is directed to forward the revised family pension proposal to the third respondent within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above said observations, this Writ Petition is disposed of . There shall be no order as to costs.
