PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent to forward the Family Pension Proposal dated 05.10.2024 submitted by the petitioner to the 2nd respondent forthwith and to further direct the 2nd respondent to consider the proposal and immediately sanction family pension to the petitioner with effect from 01.11.2016 within a time frame to be fixed by this Court. 1/4

ORDER

The instant Writ Petition has been filed seeking a mandamus to direct the third respondent to forward the family pension proposal dated 05.10.2024, and further direct the second respondent to consider the said proposal.

2. The petitioner's father who was working as a lineman in the TANGEDCO, had attained superannuation on 31.05.1993, and he passed away on 13.12.2002. Thereafter, the petitioner's mother was receiving the family pension. She also passed away on 31.10.2016.

3. According to the learned Counsel appearing for the writ petitioner, he is a physically challenged person and he is eligible to receive family pension. Therefore, the petitioner has submitted his application before the third respondent on 05.10.2024, seeking family pension. However, so far, the third respondent has not forwarded the said application to the second respondent. Hence, the present writ petition has been filed. 2/4

Considering the above said facts, the third respondent is directed to forward the family pension application of the petitioner to the second respondent within a period of eight weeks from the date of receipt of a copy of this order. Thereafter, the second respondent is directed to consider the same and pass appropriate orders on merits and in accordance with law within a period of twelve weeks thereafter.

5. With the above said observations, this Writ Petition is disposed of . There shall be no order as to costs.
